By using this website you have accepted and you will be subject to the terms and conditions outlined below. Please read these terms of use carefully as continued use of the website will signify acceptance hereof.
The terms and conditions relate to our website and contains specific provisions to limit our liability, allocate liability or risk to you and constitute acknowledgement of this fact by you. You should pay particular attention to these terms since they limit your ability to recover losses that you may incur in connection with your use of our website.
We are not the organiser of any event listed on the website. We are a technology/platform provider that third-party organisers/organisations use to sell and or promote tickets and or collect data for their and or their customer’s events.
When purchasing tickets and or registering to these events you are paying money directly to and contracting directly with the organiser of the event, event promoter, and or third-party organisations as indicated under “Third Party Organisations” above, not with “us”.
All policies, terms and conditions, costs and information relating to and of the event is set by the organiser of the event, event promoter, and or third-party organisations and not by “us”.

“We”, “our” and “us” referred to in these terms refers to expowiz as well as Green Exhibition Services CC, its employees, owners, agents, contractors, and affiliates.

Our website is a web-based SAAS (Software as a Service) and allows you to access our online platform to sell and manage event tickets and related physical or digital products and services. You may only use this website if you are an Event Promoter or an authorized ticket seller (and you have the written permission of the Event Promoter for all events for which you sell tickets). If you wish to use the Services on behalf of a legal entity, you agree to these Terms on behalf of that legal entity and represent that you have the authority to do so.

We provide services to you and have no relationship with your customers ("Ticket Buyers", “Event Promoters”, “Authorised Ticket Sellers”). When you sell tickets or other products and services to your customers through the expowiz website, the contractual relationship is between you and your customer and/or client. It is your responsibility to provide your customers and/or client with your terms of sale. We will direct any customer and/or client to you who raises queries regarding your events or your other products and services:

Your Account:
Once you have access to the expowiz system, you can instantly set up your event, create tickets for your event, and depending on your user rights create an account with the payment processor and sell your event tickets. You can also set up the sale of any related physical or digital products.
You must be 18 years old or over to use expowiz. You can make changes to your account according to the features available on your account dashboard.

Account Security:
You are responsible for maintaining the security of your account and are solely responsible for all activities that occur as a result of accessing your account using your access credentials. Where we have provided you (or where you have chosen) the password or API key that allows you to access your account, certain parts of our website or applications, or if you have invited team members to access your account, certain parts of our site or for our applications, it is your responsibility to keep your password or API key confidential. You must not share your password or API key with anyone. You agree to notify us immediately by sending an email to derek@greenexhibitions.co.za of any unauthorized use of your password, API key, account, or other breach of security. We will not be liable for any loss or damage arising from your failure to comply with this provision.
The transmission of information over the Internet is not completely secure. We cannot guarantee the security of your data transmitted to our site and any transmission is at your own risk. Once we receive your information, we will use strict procedures and security features to try to prevent unauthorized access.

Payment processor:
Our Service allows you to accept payment for your event tickets, products, and services from online ticket buyers using payment processors. Your use of the Payment Services requires the creation of an account with the payment processor you wish to use, which will be subject to the terms and conditions of the processor and their Privacy Policy. You will have a direct relationship with the payment processor and will need to read and agree to their terms and conditions before accepting payment from a ticket purchaser through the payment service offered through our Services. When performing certain functions, the payment processor acts as a data processor for you, but in other ways, the payment processor acts as a controller. The activities of a payment processor conducted as a controller are conducted in accordance with the payment processor's privacy policy. By using these payment services, you acknowledge and agree that we share your personal information and/or information about your transactions conducted through this service with payment processor.
If we receive notice from a payment processor that your use of their services violates its terms or any agreement between you and them, you and us, or between you and a ticket purchaser, appears to be fraudulent, violates money laundering regulations, or engages in other malicious activities, we may take action including but not limited to the actions necessary to remedy the breach you have made, remove your ability to use the Payment Service and/or suspend or terminate your account. The payment processor has the right to refuse to use its payment services to anyone, for any reason, at any time.

We have no responsibility for, and hereby disclaim all liability (including, but not limited to) any losses, costs, fees and penalties of whatever nature arising from the service provided to you by the Payment Processor, including the acts and omissions of the Payment Processor.
You must ensure that the proceeds of all credit and debit card sales transacted via expowiz are paid into a segregated bank account meaning that they are separated from your own working capital. These arrangements are in line with best practice as specified by all major credit card companies.

Our Fees

Our fees are non-refundable, even if an event is cancelled.

Each invoice submitted to you by us is payable within 10 days from the date of the invoice.

Without prejudice to any other right or remedy that we may have, if you fail to pay us on or before the due date (including if a card payment fails), we may:

charge interest at a rate of 7% from the due date for payment until payment is made and you shall pay interest immediately on demand; and/or
suspend the provision of the Service until payment has been made in full.

You Agree To:

make all communications with your customers and not refer them to us for customer support.
Answer any questions you receive from your customers within 5 days;
assume all obligations related to the contractual relationship between you and your customer;
If the event is cancelled, rescheduled or significantly changed from the original information provided when the event was first sold, please notify your ticket buyers immediately and update your event details accordingly in expowiz.
We reserve the right to suspend or terminate your access to the Service if you fail to comply with this contractual relationship with your customers.
You agree to accept all contractual liability between you and your customer, guest, or ticket buyer.
As a third-party data collector and processor, we do not have controller rights to the data, this data is controlled by you and may be shared with your client and is subject to yours and their privacy policies.
All payments and refunds are to be managed by you.
Expowiz does not take responsibility for merchant/bank/financial institution’s fees or transaction fees on tickets.
We will not be held liable for any special, direct or indirect, consequential losses of any kind arising from any reservation, booking or transaction save to any liability that cannot be excluded by law.
Furthermore you will defend and hold harmless Expowiz and affiliated or related companies and their respective joint ventures, successors, assigns, directors, officers, employees and agents and shall keep each of them fully and effectively indemnified against any and all losses, imposed on, incurred by or asserted against them for all losses, damages, claims or actions in respect to but not limited to system unavailability or malfunction, power failures, loss, corruption or destruction of data, theft or vandalism, interruption of communications links or incomplete, missing or inaccurate information.
Access to our website may be suspended temporarily and without notice in the case of system failure, maintenance or repair or for reasons beyond our control. Your access to the Service may also be suspended, or your account may be cancelled at any point, at our discretion, including (but not limited to) if we suspect that you are using the Service for fraudulent or criminal purposes, if we are advised to by law enforcement agencies or if you have failed to pay the service fee (in which case we would typically notify you of the non-payment before suspension or cancellation). We will not be liable for any loss or damage that may arise from misuse of our service.
Comply with applicable laws and obligations in connection with the provision of events, products or services to purchasers of tickets, or your receipt of booking fees, transaction fees or charitable contributions.
